Jurisdiction

Reference shall be made to three Arbitrators, wherein, each party shall appoint one Arbitrator and the two appointed arbitrators shall in turn jointly appoint the third Arbitrator. The venue of the Arbitration shall be Mumbai and the language of the Arbitration shall be English.

Any legal actions pertaining to this web site shall be commenced within the competent courts in Mumbai to the exclusion of other courts.

Beautiful Homes Presto Terms and Condition

These terms constitute a legally binding agreement (“Agreement“) between the Client and Asian Paints Limited ("Company"). The Client represents that he/she is legally competent to enter into this Agreement. The Client further warrants that they have read, understood, and agreed to abide by the below terms and conditions.

"The Company offers two models under the Beautiful Homes Presto Services. The two models* are as follows:

a. 35 Days Offer* - This offer includes:

Wardrobes & other Fitted Furnitures. Fitted Furniture means the Company's branded modular furniture.

Basic Electrical  

b. 50 Days Offer* - This offer includes:

Modular Kitchen

Wardrobes & other Fitted Furnitures. Fitted Furniture means the Company's branded modular furniture.

Basic Electrical

The Company uses HDF(High Density Fibre Board) as a core material, offering limited shades for Fitted Furniture and Kitchens. The use of the said material is not absolute and might change as per availability or the management's discretion.

Further, only the wall panels available with the Company's stock will be supplied to the Client. "

The Company reserves the right to make the final decision on undertaking a site under Beautiful Homes Presto Services based on the site conditions and the scope of work as determined by the Company's representative.

The site should be in possession of the Client and the Client must ensure that the site is accessible to the Company’s personnel during working hours for the duration of the project.

 The Client is responsible for ensuring that the site is cleared and prepared for work to commence, including the removal of any existing furniture or obstructions.

The Client will be responsible for obtaining any necessary permits or approvals, if any required for the execution of the work at the site.

The quotation provided by the Company to the Client will be valid for a period of 45 days from the date of booking.

"The project will be completed within the aligned timeline (30/50 days) after the design-off and receipt of full payment by the Client. The payment for the services shall be made in the following manner:

a. 15% to be paid at the time of booking the services (inclusive of GST);

b. Remaining 85% to be paid in advance post design closure (inclusive of GST);

c. All the payments will be effected by way of electronic transfer. Cash Payments will not be accepted. "

Amount paid by the Client at the time of booking the services is non-refundable. 

The Company shall have the right to appoint third party Contractors and/or installers based on scope of work in the BOQ / Quotation to execute the work at the site.

The personnel of the Company will carry out the work on Monday through Saturday from 10:a.m. to 6:00 p.m. Any work required outside these hours must be agreed upon in advance and may incur additional charges.

Power, water for sewage use and drinking water, etc. shall be provided by the Client.

All work will be carried out in accordance with industry standards and the specifications agreed upon in the design phase.

For any delay beyond the committed timeline, the Company will bear a penalty of Rs. 500/day, up to a maximum of Rs. 30,000/-. The Client acknowledges and agrees that the payment of Rs. 30,000/- by the Company shall constitute the sole and exclusive remedy available to them and the Client hereby waives any and all other remedies, whether in courts or otherwise that may be available to them.

Timelines of any external vendors (utilities) will be independent and not considered within APL’s timeline.

All material selection by the Client must be made from a predefined catalogue during the design phase. No changes to materials or designs will be accommodated after the finalization of the design and the quote approval.

If the Client supplies any materials or items to the Company, the Company is not responsible for its quality, suitability, or any delays caused by them.

The Client must ensure that no civil work is undertaken during the tenure of the project.

The Company will not undertake any civil work on the site except for the kitchen countertop, dado tiles, basic electrical shifting, basic painting, and false ceiling.

All electrical, tiling, painting, or any civil work must be completed prior to installation of the modular furniture at the site, ensuring no such work by the Client is in progress during the installation phase. 

The Company is not responsible for any damage to existing structures, utilities, or finishes that were not disclosed prior to the commencement of work.

Kitchen/ Modular Furniture will be handed over to the Client in usable condition. The details of the same is provided in the Annexure annexed with these Terms and Conditions.

The Company may on Client’s request provide specialty textures, wallpapers, etc.. However, the time taken for providing these services will be excluded from the committed timeline.  

The Company will not be liable for delays caused due to - i)  delay by the Client in handing over the site ii) disruption in work due to the engagement of any contractor/agency by the Client for any work at the site or for any reason attributable to the Client. iii) Force Majeure Events.  For the purpose of this clause a “Force Majeure” event is an Act of God, epidemics, pandemics, accidents, fires,  promulgation of any law or regulations by the Government, restrictions imposed by the residential societies or any other unforeseen circumstances, that prevents or delays the Vendor from performing its obligations under the Agreement and that is not attributable to the Vendor.

Upon completion, the client will conduct a final inspection with the Company's Personnel. Any deficiencies must be reported within 15 days of handover post which no claims shall be entertained.

Company reserves the right to terminate this Agreement immediately in case of unreasonable delays, frequent changes in the scope of work, arbitrary demands or misbehavior on the part of the Client.

"Exchange, Cancellation, Returns, Replacement & Refunds Policy:

• Any proven defects / damages on products shall be subject to the terms & conditions of warranty applicable on said products.

• Any non-manufacturing defects and / or damages to the products after delivery / installation shall not be liable for returns or replacements or refunds."

These Terms and Conditions will be governed by and construed in accordance with the laws of India and the competent courts at Mumbai alone shall have the exclusive jurisdiction with regard to or in connection with any disputes arising under this Agreement between the parties hereto.

Acceptable Issues

  2. 1. Shutter Bending:
  3. • A minor bending of up to 5mm in the shutters is considered acceptable. This tolerance is within the industry standards and does not affect the overall functionality of the product.
  4. 2. Surface Scratches:
  5. • Superficial scratches on Polyurethane (PU) coated surfaces or laminate finishes that are less than 10mm in length and not deeper than 0.5mm are deemed acceptable. These scratches do not compromise the structural integrity or aesthetic appeal significantly.
  6. 3. Color Variations:
  7. • Slight color variations in wooden components are natural and acceptable. This includes minor differences in grain patterns and hues, which do not affect the product’s performance or durability.
  8. 4. Laminate Blistering:
  9. • Bubbles or blisters on laminate surfaces that are less than 3mm in diameter and occur infrequently (no more than two per square meter) are acceptable. Such issues can often be rectified without compromising the overall quality of the product.
  10. 5. Minor Edge Chipping:
  11. • Small chips (less than 2mm) on the edges of panels are acceptable as they do not affect the overall functionality or appearance when assembled.
  12. 6. Minor Hardware Discoloration:
  13. • Slight discoloration or tarnishing of non-visible hardware (such as internal screws) is acceptable, provided it does not affect the hardware’s performance or durability.
  14. 7. Packaging Marks:
  15. • Light marks or impressions on surfaces caused by packaging materials that can be easily cleaned or polished away are acceptable.
  16. 8. Defective Laminate Application:
  17. • Peeling or delamination of the laminate is not acceptable. This includes any instances where the laminate is lifting off the substrate, as it can lead to further deterioration over time.
  18. 9. Functional Wardrobes: If the wardrobe is in a functional condition and only minor touch-ups, such as edge banding or paint touch-ups, are pending.

Unacceptable Issues

 

1. Major Shutter Deformation:

• Any shutter bending exceeding 5mm is unacceptable. Significant deformation can impact the alignment and functionality of the doors, causing operational issues.

2. Dent and Deep Scratches:

• Any dent or deep scratch (greater than 0.5mm deep or 10mm long) on the shutters or panels is unacceptable. These damages can affect the product’s aesthetics and may indicate potential structural weakness.

3. Hardware Failure:

• Any hardware that does not function correctly (e.g., hinges that do not close smoothly, sliders that jam or are misaligned) is unacceptable. Proper functioning hardware is crucial for the usability of the product.

4. Surface Contamination:

• Any contamination of surfaces by chemicals, oils, or other substances that cannot be cleaned off and affects the appearance or safety of the product is unacceptable.

5. Mismatched Components:

• Any components that do not match the specified design, color, or finish (e.g., doors of a different shade than specified) are unacceptable. Consistency in design and appearance is crucial for customer satisfaction.

6. Incorrect Dimensions:

• Any deviation from the specified dimensions beyond the allowed tolerance (e.g., +/- 2mm for critical dimensions) is unacceptable. Such discrepancies can result in improper fitting and installation issues.

Replacement and Repair Policies

• Bubbles and Blisters: Any bubbles on laminate or PU surfaces exceeding the acceptable criteria (greater than 3mm in diameter or more than two per square meter) will be replaced or repaired free of cost.

• Dents and Deep Scratches: Shutters or panels with dents or deep scratches that do not meet the acceptable criteria will be replaced or repaired at no additional cost.

• Structural Issues: Any structural issues such as cracks or significant deformations will be addressed immediately through replacement or repair to ensure the product’s integrity and performance.

Policies on Acceptable Issues

• Edge Chipping: Minor edge chipping less than 2mm is considered within acceptable limits. However, customers can request touch-up services if desired.

• Hardware Discoloration: Slight discoloration on internal, non-visible hardware is acceptable and does not require replacement. If discoloration affects visible hardware, it will be replaced at no cost.

• Packaging Marks: Light marks from packaging that can be cleaned are considered acceptable. Cleaning instructions or services will be provided if necessary.

Conclusion
