This Data Privacy Notice describes the information that Asian Paints (Asian Paints Limited and its group companies and subsidiaries) collects about you; how we use and protect this information; and the choices you can make about how we use this information.

Our privacy practices are consistent with applicable data protection laws in India.

Information Covered by This Privacy Notice

This Privacy Statement applies to information, including personal information, collected about you by Asian Paints.

Personal information is information, or a combination of pieces of information that could reasonably allow you to be identified.

Sensitive personal information is such personal information related to you that is collected, received, stored, transmitted or processed by Asian Paints, consisting of or reveals or related to or constitutes -

ii.    PAN Card or Aadhar Card

iii.   User details as provided at the time of registration or thereafter;

iv.   Financial information such as Bank account or credit card or debit card or other payment instrument details;

v.    Call data records;

vi.   Physical, physiological and mental health condition;

vii.  Sexual orientation;

viii. Medical records and history;

ix.   Biometric information;

x.    Caste or Tribe

xi.   Religious or political belief or affiliation; or

xii.  Any detail relating to the above personal information categories as provided to Asian Paints for providing service; and

xiii. Any of the information received under above personal information categories by Asian Paints for processing, stored or processed under lawful contract or otherwise.

Information We Collect

We may collect information about you from a variety of sources, including information we collect from you directly; information we collect about you when you visit our sites, use our services, or view our online advertisements; and information we collect about you from other sources (as permitted by law) including our authorised dealers.

Information we collect directly from you:

We collect information directly from you when you choose to participate in our offers and programs or otherwise provide information directly to us. The following are examples of information we may collect directly from you:

-  Name, email address, postal address

-  Username and password

-  Phone number or mobile number

-  Age

-  Gender

-  Date of birth

-  Demographic information

-  Photographs or videos

-  Payment instrument details (such as a credit card information).

Information we collect from other sources:

We may obtain information about you from other sources, including our authorised dealers, contractors, vendors, commercially available sources, such as data aggregators and public databases etc. However, we shall not be responsible for their data security processes and should not be held liable in case of breach of privacy which can be attributable to their negligence, omission or commission. The following are examples of information we may collect from other sources:

- Name, postal address

- Age

- Income level

- Consumer and market research data

- Photographs or videos

- Purchase behaviour

- Publicly observed data or activities, such as blogs, videos, internet postings, user generated content, and in-store shopping behaviour (at Asian Paints’ Colour World and signature stores)

All of the information we collect about you may be combined to help us tailor our communications to you and to develop products and services suitable to your needs.

How We Use This Information

To provide offers, products and services. We use the information we collect to provide the products and services you request, to tell you about other products and services offered by Asian Paints, to fulfil our obligations for ‘Know Your Customer’ under applicable regulations and to manage our sites and services.

The following are ways we may use the information we collect about you:

-  Send samples, products and information

-  Enroll you in contests, loyalty programs, or offers you request

-  To provide you with other services offerings that you have requested

-  Create and manage your account on our customer websites, portals and IT systems

-  Process payment for purchases or other services

-  Develop and provide advertising tailored to your interests

-  Analyse the use of our products and services

-  Determine the effectiveness of our advertising

-  Enforce the terms and conditions of our agreements with you, and otherwise lawfully manage our business.

Your Choices and Access to Your Information

Choices:

We give you choices about how we communicate with you.

-  Digital and Electronic Communications: We only send you promotional mobile or email messages if you explicitly ask to receive these (you opt in). You can stop receiving promotional email messages from Asian Paints by following the instructions provided in any such message you receive from us.

-  Postal Mail: We may mail you offers or product information that you have asked to receive from us. Promotional postal mail may contain opt out instructions, and you can stop receiving promotional postal mail for Asian Paints’ products and services (such as the Beautiful Homes Guide, Colour Consultancy) by following these instructions.

-  Voice Calls: We may call you on the telephone or mobile number provided by you for communication related to transactions, product/ service promotions and marketing, and products/ services provided to you by Asian Paints. If you are on the National Do Not Call Registry we will not call you with any product/ service promotional information.

If you choose to stop receiving promotional messages from us, we will honor your request. However, we will continue to send you service related communications and we may need to keep the information we have collected about you for record keeping, analysis or other reasons, to the extent permitted by law.

Access:

We take steps to keep your personal information accurate. You can view, correct or update the personal contact information you provide to Asian Paints. APL shall not be responsible for any harm arising out of incomplete or inaccurate and any personal information which is not up to date.

Where we are unable to give you direct access to your personal information records, please contact us at customercare@asianpaints.com to access and update the personal information you provided to Asian Paints. We will respond to valid requests in an appropriate timeframe.

Providing your personal and sensitive personal information is optional. Also, you may withdraw your consent given hereby anytime later by specifying the reason in writing for such withdrawal. In case you choose not to provide your personal or sensitive personal information or withdraw your consent, you may or may not be allowed to avail the services offered through this system.

Information Sharing

We share your personal information within Asian Paints, and externally only as described below:

-  External marketers - In general, we do not share personal information with marketers outside Asian Paints unless we have clearly asked for and obtained your explicit consent.

-  Third-party service providers - We rely on third-party service providers to perform several services on our behalf. In order to perform these services, we may need to share your personal information with them. For example, we may rely on a service provider to:

-  Place your product and service requests and answer your questions

-  Deliver our email, mobile and postal messages

-  Mail product samples, manage payments or take other actions on our behalf

-  Analyse data, sometimes combined with other sources, to develop targeted communications for you

-  Conduct research and analyse data to improve our products, services and sites

We provide these companies with the minimum personal information they need to provide these services on our behalf. Our agreements with these companies require them to protect this personal information and only use it for identified purposes. Such contractual obligations include Non-Disclosure Agreements and information security requirements.

-  Sale of our brands or business - In connection with the sale of one or more of our brands or a part of our business to a different company, we reserve the right to transfer your personal information to a new owner that agrees to offer equivalent safeguards for the use and disclosure of your personal information.

-  Legal action and obligations - We may disclose your personal information:

-  Where permitted by law, to protect and defend the rights and property of Asian Paints (including enforcement of valid agreements).

-  When required by law or public authorities.

User Generated Content

Some Asian Paints services enable customers to submit their own content for contests, customer forums and service requests (such as our Colour Consultancy services). Please remember that any information you disclose on the customer forums becomes public information and you should exercise caution when deciding to disclose your personal, financial or other information in a submission. Asian Paints cannot prevent such information from being used in a manner that may violate this Privacy Statement, the law, or your personal privacy and safety and is not responsible for the results of such postings.

Information Security

We are committed to keeping personal information secure. We have appropriate technical, administrative and physical procedures in place to protect personal information from loss, misuse or alteration.

We limit access to personal information only to those who have a business need.  

When we collect or transmit sensitive information such as a credit card number or internet banking password, we use industry standard methods to protect that information.

Information retention

We will only retain your personal data for as long as it is necessary to fulfil the purposes outlined in this policy or the purposes of which you have otherwise been informed. This means that once you have consented to our processing of your personal data, we will retain your data in accordance with the consent given and/or until you revoke your consent. If you have revoked your consent, we may nevertheless retain certain personal data for the period required in order for us to meet our legal obligations and defend ourselves in legal disputes. If we have not obtained your consent to the processing, the data will only be retained for as long as such a period of time as permitted by law.

Information Transfer

Your personal information may be processed in a country other than the one in which it was provided. When we do so, we take into consideration the applicable data protection laws for the transfer of personal information.

We will post changes to this privacy notice and update the effective date when this privacy notice is updated. We may modify this policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on this site.
