By accessing and using this  Contractor Finder, you confirm that you have read, understood and accepted (unconditionally and irrevocably) the Terms & Conditions pertaining to the use of this Website (T&C) which along with the below Terms of Use & Disclaimer (Terms of Use) shall govern any use of this directory / portal between Asian Paints Ltd. (“AP”) and the person accessing this portal/directory (User).

1.  By accessing and using this Contractor Finder, User represents that they are at least 18 years of age and competent to enter into a legally binding and enforceable contract.

2.  User agrees and undertakes to not use the contractor / portal for any data mining or data scraping activity, to compile a similar collection of listings or for any unsolicited commercial emails.

3.  This Contractor Finder is intended to facilitate the search process of the User for contractors in the specified location or area. User may view and use the portal/directory for personal purposes only.  It is expressly understood by the User that AP in no manner requires Users to use this directory and the same has been provided for the convenience of the Users only. The contractors have been listed objectively and APL’s role is only one of passive facilitation

4.  This directory/portal is not intended to be, nor should the User construe it to be, any sign of affiliation or endorsement by AP of any contractor mentioned herein. AP does not receive any commission or incentive through any interaction or transaction between the User. It is further clarified that any work undertaken and performed by contractor(s) will be in their capacity as an independent contractor(s) and there exists no agency between AP and any of the contractors listed. Contractors are not bound to AP in any manner by virtue of this listing and are free to advise User in all respects as per their professional opinion.

5.  AP has no control over listed contractors, nor does it investigate, assess, validate or certify the contractors listed on this directory or portal and nor do we make any certification, representations or warranties as to the professional competency, authenticity of claims with respect to the quality of services, training, experience and / or any other information pertaining to the Contractor on this directory. It is recommended that Users perform all the relevant checks, assessments and due diligence to their satisfaction on all relevant aspects prior to choosing and engaging any contractor. AP further disclaims all liability in respect of any service or work undertaken and executed by any contractor listed herein nor shall AP accept any responsibility for any transaction executed by the User and any such contractor. It is expressly understood by the User that the contractor(s) is an independent contractor and any dealing between customer and vendor will be an independent contractual arrangement in which AP shall bear no role or liability towards the services. Further contractor is not obligated to use AP products only.

I.  Objectionable Content: AP reserves the right block / remove any feedback, comment or post which -

a.    is obscene, indecent, pornographic, profane, sexually explicit, threatening, or abusive;

b.    constitutes or contains false or misleading indications of origin or statements of fact;

c.    slanders, libels, defames, disparages, or otherwise violates the legal rights of others;

d.    causes injury of any kind to any person or entity;

e.    infringes or violates the intellectual property rights (including copyright, design and trademark rights), privacy or publicity rights or any other rights of any third party;

f.     violates any applicable laws, rules, or regulations;

g.    impersonates another person or entity, or that collects, extrapolates or uses any information about site visitors.

II.  Intellectual Property:

a.  Users (including Contractors) who have uploaded content on this directory / portal have represented and warranted that they have the required rights, permissions and/ or authority to permit AP to use it on the Contractor Finder. AP disclaims any and all responsibility and liability in respect thereof and Users (including Contractors) hereby agree to indemnify AP against all losses, damages, claims, proceedings, suits or actions and/or other adverse consequences which may arise out of or result in third party claims of infringement of intellectual property rights.

b.  If the content uploaded by Users (including Contractors) infringes copyrights or other intellectual property rights of others, AP reserves the right to have such content removed or suspended in whole or part, pending enquiry or on a permanent basis. AP reserves the right, in the appropriate circumstances and at our discretion, to disable and/or block users who repeatedly infringe or are flagged / charged repeatedly with infringing the copyrights or other intellectual property rights of others.

c.  If a User believes that any material hosted by AP infringes their copyright or trademark rights, they may flag the same to AP by emailing on customercare@asianpaints.com and providing the following information:

(i) identifying the copyrighted work or trademark claimed to have been infringed and providing reasonable proof thereof;

(ii) identifying the material that is claimed to be infringing or the subject of infringing activity, and unambiguous information reasonably sufficient to allow AP to locate the material on the Contractor Portal

(iii) information reasonably sufficient to permit AP to contact the complaining party, such as the name, address, telephone number, and email address (if available) of the complaining party;

(iv) a statement that the complaining party believes, to the best of his knowledge and in good faith, that use of the material in the manner complained of is not authorized by the copyright or trademark owner.

III.  Governing Law and Jurisdiction:

The Terms of Use shall be governed and construed in accordance with the laws in India. Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
